Is the husband considered unjust to his wife by keeping her in his bond, knowing that he does not desire her or want to have children with her, and he has made that clear to her, yet she chose to remain with him, content with that?

The answer

Marriage may not succeed despite the righteousness of both spouses, due to a person's desire for children. If you do not desire children, it is likely due to influences that have affected your innate disposition (fitra). You may not be pleased with your wife, yet still desire success in the marriage. However, marital discord or dissatisfaction with one's wife is not a justification for shunning procreation.

Advice: Marry another if you are able, review your situation, consult those you trust, and pray to Allah to guide you to what is right.

It is not permissible for you and your wife to agree to prevent procreation, as it is harmful to her. Temporary contraception is permissible for a legitimate Shar'i need, such as spacing out pregnancies, or if pregnancy would harm the woman's health.

You must give your wife her other rights as long as she is content with you. It is not permissible to deny her rights due to your dislike of her. The Messenger of Allah (peace and blessings be upon him) said: "A believing man should not hate a believing woman; if he dislikes one of her characteristics, he will be pleased with another."

If you are unable to give your wife her full rights, you may give her the choice between continuing with you or divorce. If the aversion only leads to further complications, then separation is the best option.
