Is the wife entitled to request separate housing due to the residence of the husband's female relative, who utters insults and acts as if she owns the house?
Allah has made it obligatory for the husband to provide a legitimate, separate dwelling for his wife. The wife's right to this falls away if the husband stipulated the residency of one of his family members with her and she consented to it before the marriage contract. In this case, she is bound to fulfill the condition, in accordance with His, the Almighty's, saying: "O you who have believed, fulfill [your] contracts."
This condition ceases to be valid in two cases: 1. The husband waives it. 2. The wife suffers harm from the residency of the person she had consented to.
If the husband does not waive the condition and harm is proven, the wife has the right to demand the removal of the harm or to move to another separate house. Otherwise, she may refer the matter to the judiciary.
