Is it permissible for a woman to perform the obligatory Hajj without her husband's consent?

The majority of scholars (Hanafi, Maliki, Hanbali schools, and one view among the Shafi'is) hold that a wife may go out for the obligatory Hajj if she finds a mahram, and her husband does not have the right to prevent her from it, nor is he required to go with her. However, he may prevent her from performing a supererogatory Hajj. They base this on the argument that the husband's right does not take precedence over individual religious obligations (fara'id al-a'yan).

The Shafi'is (according to their most authoritative opinion) maintain that the husband's permission is required for both obligatory and supererogatory Hajj, because her departure infringes upon his right, and the right of a human being takes precedence, and because Hajj is obligatory with deferment (i.e., not immediately binding). This is unless she fears physical inability and two doctors testify to that.

The more evident opinion is that of the majority, due to the incorrectness of prioritizing the right of a human being over the right of Allah, and because the preponderant view is that Hajj is immediately obligatory.
