Is it considered a divorce if a man says to his wife, "When such-and-such money comes, take it as a deferred dowry and maintenance," without uttering the word divorce or intending it?

This phrase is not considered a divorce because it is not one of the allusive phrases of divorce, and intention is considered essential in allusive divorce by the jurists. It is presumed that the husband intended to rid himself of the deferred dowry, and if he did not intend divorce, then it does not occur. This is supported by the action of the Prophet, peace and blessings be upon him, with the woman who sought refuge from him and with Ka'b ibn Malik. The word becomes a divorce only with intention.
