"Whoever intentionally smells perfume while in a state of , knowing it is forbidden and remembering his ihram, has committed a prohibited act and is obligated to pay the (expiatory sacrifice). However, if he was ignorant of the ruling or forgot his ihram, then there is nothing upon him. This is supported by Ibn Qudamah's statement in Al-Mughni that 'whoever intentionally smells perfume by an act of his, the fidyah becomes obligatory upon him, such as one who sits by perfumers to smell their scent, or enters the Kaaba to smell its perfume, or carries perfume with him to smell its scent.' As for smelling it unintentionally, such as one who sits by perfumers for a need, or enters the market or the Kaaba for blessings, there is nothing upon him, because it is impossible to guard against this."
