What is the ruling on someone who passionately kissed a non-mahram woman during the daytime in Ramadan, without intending intercourse, and a short while later semen was released without further action?

Kissing a non-mahram (definition) woman is forbidden, and it is even more reprehensible in Ramadan (definition). The one who does it must repent to Allah Almighty by feeling remorse and resolving never to return to it. If the kissing results in the emission of semen, the fast is invalidated and must be made up.

Ibn Qudamah al-Hanbali stated in "Al-Mughni" that kissing by a fasting person has three scenarios: 1. No ejaculation (of semen): This does not invalidate the fast, based on Aisha's hadith (definition) that the Prophet, peace and blessings be upon him, "used to kiss while he was fasting, and he was the most in control of his desire among you." 2. Ejaculation (of semen): This invalidates the fast by consensus, because it is an ejaculation resulting from direct contact. 3. Ejaculation (of pre-seminal fluid - madhy): This invalidates the fast according to Imam Ahmad and Malik, but does not invalidate it according to Abu Hanifa, Al-Shafi'i, and others, because it does not necessitate ghusl (definition) (ritual bath).
