Is it permissible to give zakat to the wife of a paternal uncle who violates Islamic law and abandons prayer, knowing that the wife is the one who provides for the household and the zakat will include the uncle?

If the paternal uncle's wife is in need of financial support (nafaqah), it is permissible to give zakat to her or to her needy children. Zakat is not given to a disbeliever (kafir). One who insults religion (sabb al-din) is an apostate (murtad) disbeliever, and zakat is not given to him. It is unlawful for his Muslim wife to allow him access to herself, because a Muslim woman is not lawful for a disbeliever. The apostasy of one of the spouses dissolves the marriage contract according to the majority of jurists. The case of one who insults religion must be referred to the Sharia court to implement Allah's حكم (ruling) concerning him. Ibn Uthaymin issued a fatwa that whoever insults religion and does not pray must be advised. If he does not repent, his case should be referred to the competent authorities who will compel him to adhere to the laws of Islam. If he does not comply, he must be executed.
