Is there a legitimate (Shar'i) way to resolve marital problems without resorting to divorce, taking into account the wife's rejection of marital responsibilities and her request to live separately or symbolically, with the marriage remaining nominal? Is she entitled to what she requests, namely, that her husband not have guardianship over her, that he be exempted from her maintenance while continuing to provide for and visit their daughters, or that he marry another woman while she remains under his marital bond without equality in rights? What is the optimal course of action under these complex circumstances?

Divorce is the last resort, and one should not resort to it until all means of reconciliation have been exhausted, due to its severe consequences. The husband must address the problem wisely and understand the reasons for his wife's resentment. He should not concede to her request for divorce as long as there is a path to reconciliation. It is permissible for the husband to keep his wife even if she waives her rights to overnight stays or financial support, and this does not nullify his rights over her or his guardianship. The husband must properly raise his daughters and teach them the rights of their husbands to prevent them from following their mother's path. There is no harm in marrying another woman while still married to the first wife, and justice is not required if the first wife waives her right to it. It is advisable to perform Istikhara (prayer for guidance) and consult people of sound judgment and wisdom before making a decision.
