Is a husband who is unable to give his wife her marital rights because he despises her, after she refused to separate from him, sinful?
If the husband is unable to fulfill his wife's right to conjugal relations, and she does not wish to leave him, he may offer her a choice between divorce or remaining with him while waiving her right to conjugal relations. If she agrees, this is permissible. However, she may revoke this waiver and demand her right. If she demands it and the husband does not wish to comply, he may divorce her. The husband should be patient and treat his wife kindly, for Allah Almighty says: "And live with them in kindness. For if you dislike them - perhaps you dislike a thing and Allah makes therein much good." And the Prophet (peace be upon him) said: "No believing man should despise a believing woman. If he dislikes one of her characteristics, he will be pleased with another."
