If the husband severely beats his wife, or beats her without justification, or does not provide her with the obligatory maintenance, then the wife may refer him to the ruler (judge) to compel him to treat her kindly (cohabit in a good manner) or to divorce her while fulfilling her rights. However, if he provides for her and does not beat her except with the beating permitted by شرع (Islamic law), then she has no right to divorce.
