Is it permissible for a young woman who constantly quarrels with her husband, assaults him by hitting and cursing, hits her daughter, and has taken medication to abort her fetus, to have custody of the children, knowing that the husband sometimes curses her back?

Spouses must fear Allah regarding marital rights and not transgress Allah's bounds. The wife must recognize the immense right her husband has over her, and she is not permitted to disobey him or harm him with words or deeds. It is not permissible to hit a child who has not reached the age of reason unless there is a need, and taking medication to abort a fetus is forbidden. A woman who commits these acts is considered disobedient (nashiz). There is no blame on the husband for divorcing his wife if dealing with her is no longer effective, and custody of the children belongs to the mother unless she remarries or a condition for custody is no longer met by her.
