Why was the custodianship of the Holy Kaaba restricted to the sons of Shaybah ibn Uthman ibn Abi Talhah, and not to the sons of Uthman ibn Talhah, even though the Prophet, peace and blessings be upon him, gave the key to Uthman on the day of the Conquest of Mecca and said: "Take it, O Banu Talhah, by the trust of Allah Almighty, enduring forever, and none shall take it from you except an oppressor"?

When Mecca was conquered, the Prophet, peace and blessings be upon him, took the key of the Kaaba from Uthman ibn Talha, entered, and prayed two rak'ahs. Then he recited the verse: "Indeed, Allah commands you to render trusts to whom they are due." He then called Uthman ibn Talha, handed him the key, and said: "Take it, O Banu Abi Talha, enduring and everlasting. No one shall take it from you except an oppressor."

It is said that the Prophet handed the key to Shaybah ibn Uthman ibn Abi Talha or to both of them. After that, Uthman ibn Talha emigrated to Medina, while Shaybah remained in Mecca and kept the key. Ibn Ashour mentioned that Uthman relinquished it to his cousin Shaybah.

The Banu Uthman disputed with the Banu Shaybah over the key during the Abbasid era. Al-Mansur sought a fatwa from Ibn Jurayj, who then included all of them in the guardianship.

Al-Hattab al-Maliki mentioned that the Banu Shaybah ibn Uthman prevented the children of Uthman ibn Talha from the guardianship. They referred the matter to Abu Ja'far al-Mansur, who ordered Ibn Jurayj to testify. Ibn Jurayj testified that the Prophet, peace and blessings be upon him, said: "Take it, O Banu Abi Talha, everlasting and enduring; no one shall oppress you regarding it except an oppressor." So, he included both the Banu Shaybah and the children of Abi Talha in the guardianship.

Ibn Abd al-Barr mentions that Shaybah is the ancestor of the Banu Shaybah, who are the guardians of the Kaaba to this day.
