Does the sister from the father's side inherit with the daughter?

The sister, whether full, consanguine (paternal), or uterine (maternal), is among the heirs. She may be completely or partially excluded from inheritance, or she may inherit by a prescribed share (fard) or by residuary right (ta'sib). The full sister or consanguine sister inherits by residuary right with the daughter according to the majority of scholars. As for the uterine sister, she does not inherit with a lineal descendant. So, if someone dies leaving a daughter and a consanguine sister, the daughter receives half as a prescribed share, and the sister receives the remaining half by residuary right, based on the Almighty's saying: ﴿AND IF THERE IS ONLY ONE, SHE WILL HAVE HALF﴾. The proof for this is the hadith of Abu Musa and Ibn Mas'ud, may Allah be pleased with them both, where the Prophet, peace be upon him, ruled that the sister receives what remains after the daughters' prescribed shares. Inheritance matters are critical and complex, and a mere fatwa is insufficient. Rather, they must be referred to Sharia courts for investigation and to ensure that there are no wills, debts, or rights that take precedence over the heirs' rights.
