Is a wife considered sinful for seeking divorce from her husband after three years of marriage due to her intense dislike of him, and her claim that he is deceptive, a liar, irresponsible, negligent in his work, frequently uses usurious credit cards, in addition to being ill-tempered, and abusing her with insults and beatings, which has negatively affected her psychological state and that of their daughter, making her averse to the marital relationship, knowing that her family supports her decision?
There is no harm for a woman in seeking a divorce if there is a legitimate Sharia justification for it. However, she is forbidden from seeking it if there is no such justification, based on the Prophet's (PBUH) saying: "Any woman who asks her husband for a divorce without any legitimate cause, the scent of Paradise will be forbidden to her." So, if there is a reason that justifies seeking a divorce, then there is no harm upon her.
