Is it unlawful for a wife to leave her husband’s home without his permission to escape harm from his family and to demand her legal right to housing, and does her divorce take effect upon her husband’s saying: “If you leave the house, then you are divorced”?

Problems often arise between a wife and her husband's mother. It is the wife's right for her husband to provide her with a separate dwelling.

We advise the wife to be patient and to supplicate. Among the appropriate supplications are: "There is no god but Allah, the Almighty, the Forbearing. There is no god but Allah, Lord of the heavens and the earth, and Lord of the Magnificent Throne," and also, "O Allah, Your mercy I hope for, so do not abandon me to myself even for the blinking of an eye, and set all my affairs right for me. There is no god but You."

It is permissible for a woman to leave her house without her husband's permission if she has an excuse. If the wife was unaware of the divorce conditioned upon her leaving until after it occurred, then according to the Shafi'i school, the divorce does not take effect.

We advise involving wise individuals, striving for reconciliation, and taking necessary precautions for the stability of the family, especially with the presence of children.
