Whoever passes the Miqat without entering into a state of Ihram must return to it to assume Ihram from there. If one passes the Miqat and then assumes Ihram, a sacrifice (dam) is required of him (a sheep to be slaughtered in Makkah and distributed among the poor). This is the view of the Malikis and Hanbalis. The fatwas of Ibn Baz and Ibn Uthaymeen support this.
