The sons of a full brother inherit from their paternal uncle if there are no closer 'asabah (agnate heirs) and something remains of the estate after the اصحاب الفروض (sharers) have taken their shares. So, if the uncle dies leaving a daughter and the sons of a full brother, the daughter takes one-half as a fixed share, based on the Almighty's saying: "And if there is only one, she will have half." The sons of the full brothers take the remaining half as 'asabah, based on the Prophet's (peace be upon him) saying: "Give the fixed shares to those entitled to them, and what remains is for the closest male relative." As for the sons of a half-brother (from the father's side), they are excluded by the sons of full brothers, and the sons of a half-brother (from the mother's side) do not inherit. It is advisable to refer inheritance cases to Sharia courts for investigation.
