What is the ruling of the Sharia on a husband who rapes his wife, then refuses intimacy, then beats her and has intercourse with her against her will?

If a husband calls his wife to bed, she is obligated to respond unless there is a legitimate excuse, such as illness. If she refuses, she is considered disobedient (nashiz), and the husband has the right to admonish her, then forsake her in bed, then strike her with a non-bruising blow. Her right to maintenance (nafaqah) and clothing is forfeited. It is not permissible for the husband to strike his wife severely, or on the face, or in dangerous places. Nor is it permissible for him to withhold her rights and then demand his own rights from her and strike her, because that is considered oppression. If a rift between the spouses is feared, two arbitrators from their families must be sent to reconcile them. If they desire reconciliation, Allah will bring them together.
