Is it permissible to place clothing the deceased woman wore before her death under the shroud, even though she was shrouded in five wraps?
Most scholars hold the view that a woman should be shrouded in five garments, and any increase beyond that is disliked (makruh). If a deceased woman is shrouded in five garments, this is a sufficient shroud. If more garments are added with the consent of the adult, sane heirs, it is disliked but not forbidden (haram). However, without their consent, it is an transgression. The garment worn by the deceased becomes the property of her heirs immediately upon her death. Adding it to the shroud without their permission is an error. If the heirs waive their right and they are sane, then the right is waived. Otherwise, if it is possible to exhume the grave to retrieve the garment, it should be exhumed according to some scholars, and there is no guarantee (of its condition) then. If exhumation is not possible, the washer must pay the value of the garment to the heirs unless they waive their right, because error and deliberate action are considered the same when it comes to people's property.
