Is stoning after midnight on the 12th of Dhu al-Hijjah and before Zawwal (midday), then appointing someone to stone on one’s behalf (tawkeel), then repeating the stoning oneself on the 13th and before Zawwal valid, and does anything result from that, keeping in mind that there was no overnight stay in Mina on the night of the 13th?
If the stoning (rami) on the twelfth night occurs after midnight (a night that began with the sunset of the eleventh day), then the overnight stay (mabit) is valid. However, stoning before dawn is not valid, nor is repeating it on the thirteenth day before zawal (midday) according to the majority of scholars. A damm (sacrifice) becomes obligatory for abandoning the stoning of one of the Ayyam al-Tashreeq (days of Drying Meat), and hastening (ta'ajjul) is not permissible.
However, if the stoning occurs on the thirteenth night after midnight (a night that began with the sunset of the twelfth day), then the stoning for the twelfth day is valid, and the overnight stay is valid. But the failure to stone on the thirteenth day after the sunset of the twelfth day necessitates a damm (sacrifice) to be slaughtered in Mecca for its poor.
