Is a student considered a mutamatti‘ obligated to offer a hady and subject to the rulings of the people of Makkah if he comes to his family in Makkah during the summer vacation, performs 'Umrah in Dhul-Qa‘dah, and then decides to perform Hajj?

Whoever from the people of Makkah travels outside the Mawaqeet (Miqat stations), then returns to Makkah with the intention of performing Hajj or Umrah, must enter into Ihram from the Miqat station he passes by. However, if he returns to visit his family and does not intend Hajj or Umrah, he is not obliged to enter into Ihram. If he then intends Hajj, he enters into Ihram from his location in Makkah, based on the Prophet's (peace and blessings be upon him) saying: "And whoever is closer than that, then from where he originates, even the people of Makkah from Makkah."

If a student performs Umrah in Dhul-Qa'dah and then performs Hajj in the same year, he is a mutamatti' (one performing Tamattu' Hajj), and no sacrificial animal (dam) is due from him; because he is considered to be like the people of Makkah, and the people of Makkah are not required to offer a sacrifice for Tamattu' according to the majority of scholars, based on the Almighty's saying: "That is for him whose family is not present at Al-Masjid Al-Haram."
