If a man is appointed by the state to execute projects that required him to borrow money in his name and with his guarantee, then he must repay it to its owners. He can, however, refer back to the state, as he was acting as its agent, just as an agent in a purchase refers back to his principal for the price. However, if he took on the debts in his capacity as an agent for the state, then he bears no guarantee, and the demand for repayment is directed to the state, because the debt falls upon the principal. And if the state itself undertook the debts and committed to repaying them, then unjustly compelled him to repay them, then he is not obliged to repay and should not burden himself.
