To what extent is it lawful to seek divorce from a husband with whom one has not yet consummated the marriage, due to his failure to lower his gaze and his uncontrolled mixing with foreign women, especially his brother's wife?

Carelessness and negligence in a man's dealings with non-mahram women are reprehensible in Islamic law. The Sharia has taken precautions in this matter, enjoining lowering the gaze, forbidding seclusion with a non-mahram woman, prohibiting women from speaking softly when addressing men, and warning against a woman's laxity with her husband's male relatives, because "the in-law is death." Scholars have stipulated that speaking with a non-mahram woman is not permissible except out of necessity, because it is "a cause for temptation." If the husband is negligent in lowering his gaze and is overly familiar in his dealings with non-mahram women, the wife should gently advise him and inform him of the scholars' warnings regarding this matter. She should not seek a divorce from him for this reason, unless his conduct escalates to committing major sins.
