Are the two phrases uttered by the husband: "You are divorced" (أنت طالق) and "divorced" (مطلقة) - in the context of the mentioned marital disputes and the husband's asking the wife's brother about her status after she left the home - considered a legitimate divorce, and what are the rulings regarding the waiting period (iddah) and the rights and duties of the spouses during it, and how should they interact and what should they wear, and can the wife remain in the marital home after the iddah has expired given her professional and legal circumstances?
The occurrence of divorce due to anger depends on the husband's awareness of what he is saying. If he is aware, it occurs; otherwise, it does not. The husband's statement "she is divorced" is an explicit divorce, by which divorce occurs. The divorce that has occurred is revocable, and the husband has the right to take his wife back during her iddah (waiting period) without her consent or knowledge. She does not have the right to demand money for reconciliation. During the iddah, the wife is considered as a wife; thus, the husband is permitted to be alone with her and to have intercourse with her. She is not permitted to leave the house except out of necessity, and the husband is not permitted to expel her before the iddah expires. If the iddah expires, she has no right to housing.
